General terms and conditions of sale

PREAMBLE :

The present general conditions of sale are concluded between the seller A Tire d'E.L. (See legal notices) and any person wishing to make a purchase via this website, hereafter, the buyer. By validating his order, the Customer declares that he accepts without reserve the terms of the order as well as the entirety of the present general conditions of sale and declares that he has the capacity to conclude a contract with the seller.

1- OBJECT

The present conditions of sale aim to define the contractual relations between the seller and the buyer as well as the conditions applicable to any purchase made through this merchant site. These terms and conditions of sale shall prevail over any other general or special conditions not expressly approved by the seller. The seller reserves the right to modify its general conditions of sale at any time without notice: the applicable conditions will be those in force at the date of the order by the buyer.

2- CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED

The products or services offered are those presented on this commercial site and are accompanied by a detailed description. These products and services are offered within the limits of available stocks and as long as they are visible on the site. In the event of unavailability of the product or service after the order has been placed, the seller will inform the buyer by e-mail: the order will be automatically cancelled and no debit will be made.

3- RATES

The prices shown on this website are inclusive of all taxes (VAT + other applicable taxes), excluding handling, customs and transport costs which are applied and detailed at the time of ordering. The seller reserves the right to modify its prices at any time: products and services are invoiced on the basis of the rates in force at the time of validation of the order, subject to availability. THE PRODUCTS REMAIN THE PROPERTY OF THE SELLER UNTIL FULL PAYMENT OF THE PRICE.

4 - GEOGRAPHICAL AREA

The online sale of the products and services presented in this site is accessible to buyers from all over the world.

5- ORDERS

The buyer who wishes to purchase a product or service online via the site must follow the online ordering process which includes an identification phase, a phase of verification and validation of the products and services chosen, a phase of payment in the conditions provided and a phase of confirmation of the order and payment. Confirmation of the order entails acceptance of these terms and conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to invoke one's own terms and conditions of purchase or other conditions. All the data provided as well as the recorded confirmation will be considered as proof of the transaction. The seller will send confirmation of the registered order by e-mail, which will be considered as acceptance of the order.

6- PAYMENT

The price is payable at the time of order. Online payments are made by secure system so that no third party can have access to the data transmitted on this occasion.

7 - DELIVERY

For a Product ordered and delivered outside the EU, import taxes may be levied at the time of delivery or after delivery of the package to the destination address. These taxes to be paid are generally: VAT in force in the country of delivery, customs duties (calculated from the invoice accompanying the Product) and handling fees.

It is the Customer's responsibility to check with the customs services or at the local post office for more information on the amount of these taxes before placing an order.

8- RETRACTION

Non-professional buyers benefit from a cooling-off period of 14 days from the delivery of their order to return the product to the seller for exchange or reimbursement without penalty (return shipping costs at their expense). Returns must be made in their original condition (packaging, accessories, instructions, etc.) so that they can be remarketed in new condition and accompanied by a copy of the purchase invoice. This right does not apply to immediately reproducible products unsealed and to products personalised on request.

9- GUARANTEES

All the products and services provided benefit from the legal guarantee of European legislation. In the event of non-conformity, it may be returned to the seller who will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made in accordance with the terms and conditions specified on the site, with a reasoned complaint and a copy of the invoice, within thirty days of delivery.

10- RESPONSIBILITY

The seller, in the online sales process, is only bound by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the internet network such as data loss, intrusion, virus, service disruption or other involuntary problems, as well as any event qualified as force majeure. The photographs and descriptions of the products offered for sale are only indicative and are likely to present slight variations with the actual product, depending on the light, the display resolution and the different possible settings of the Buyer's screen. Likewise, each Product is handmade and therefore unique. As a result, minor differences in finish, format or colour may appear from one piece to another, which are inherent to this type of manufacturing and cannot be considered a major defect.

11- PERSONAL INFORMATION

Personal information is necessary for the management of orders and commercial relations. In accordance with the general regulations on data protection of 23 May 2018, personal information relating to buyers may be subject to automated processing. Users have the right to access and rectify data concerning them (see the privacy policy).

12- INTELLECTUAL PROPERTY

All elements of this site are and remain the exclusive intellectual property of the seller. Only private use is authorised. Any partial or total reproduction of all or part of the elements appearing on this site is prohibited.

13- SETTLEMENT OF DISPUTES

These general terms and conditions are subject to Dutch law. The language of this agreement is the English language. In the event of a dispute, the Dutch courts shall have exclusive jurisdiction.
